CHILD CUSTODY

In child custody matters, the law is concerned with the best interests of the child. In Pennsylvania, judges are required to consider 16 different factors when creating a custody order, and give special attention to the factors involving the health and safety of the child.

There are two main forms of custody in Pennsylvania: legal custody, and physical custody.

CHILD Support

In Pennsylvania, the law imposes a duty on parents to support their minor children. The amount of support a parent is required to pay is determined by the “income shares model,” a complicated formula that considers a number of factors, including the incomes of the parties, the amount of overnights each party has with the children, and the cost of health insurance and daycare for the children.

A protection from abuse order, also known as a “PFA,” is a civil restraining order that offers individuals who have suffered domestic abuse several types of relief. PFA orders can prohibit family members, significant others, or former intimate partners from having contact with the protected party, order the other person not to enter the protected party’s residence or place of employment, require a person to surrender their firearms to law enforcement, and even temporarily award custody of children.
